BONOKWAKHE NZUZA v PARK PRIMARY SCHOOL
LABOUR COURT OF SOUTH AFRICA.
CASE NUMBER: 2025-043605
Application in terms of Section 158 (1) (c) of the Labour Relations Act 66 of 1995.
CASE OVERVIEW:
This matter concerned the legality and constitutionality of long-standing fixed-term contracts used at Park Primary School. The application sought declaratory relief from the Labour Court declaring that, the continued use of those contracts were unlawful, invalid and unconstitutional. The case raised important issues concerning fair labour practices, employment security and the rights of employees who had rendered many years of continuous service under successive fixed-term contracts.
THE PARTIES:
THE APPLICANT : Bonokwakhe Nzuza
FIRST RESPONDENT : Park Primary School.
SECOND RESPONDENT : The School Governing Body.
THIRD RESPONDENT : Gauteng Department of Education.
FOURTH RESPONDENT : National Department of Basic Education.
BACKGROUND:
For many years, several employees remained employed on fixed-term contracts despite having completed more than ten years of continuous service. The applicant contended that the continued use of long-term fixed-term contracts was inconsistent with the South African labour law and constitutional principles protecting fair labour practices. Accordingly, the Applicant approached the Labour Court seeking declaratory relief.
RELIEF SOUGHT:
The Applicant requested the Labour Court to declare that the long-standing fixed-term employment contracts were; 1. Unlawful, 2. Invalid and; 3. Unconstitutional.
The Applicant further sought appropriate consequential relief arising from those declarations.
OPPOSITION:
The First and Second Respondents, Park Primary School and the School Governing Body, initially opposed the application and defended the proceedings. The Third and Fourth Respondents, namely the Gauteng Department of Education and the National Department of Basic Education, did not oppose the application. Their legal representatives filed notices indicating that they would abide by the decision of the Labour Court.
OUTCOME:
The First and Second Respondents withdrew their opposition of the matter in court and opted for the matter to be settled outside the Labour Court, as a result the application was by agreement withdrawn from the court roll pending the finalization of the matter outside court. Following that agreement, all employees who had served on fixed-term contracts for more than ten and some twenty years were converted to permanent employment in accordance with the initail relief sought in the court papers.
SIGNIFICANCE:
The matter illustrates the important role of the Labour Court in determining disputes concerning employment status and the legality of employment practices. The case also demonstrate how declaratory relief may be used to resolve systemic employment issues affecting multiple employees.
